TRANSPARENCY PROGRAM, INTRODUCTION

This transparency program summarizes all the information which AIC makes public without request on its website, considering the public’s highest interest as regarding the ensuring of the maximum familiarity with public information, in order to reduce the need for individual requests for information.

ABOUT THE ALBANIAN INVESTMENT CORPORATION

The Albanian Investment Corporation (AIC) was established by Law no. 71, dated 17.10.2019, on the “Albanian Investment Corporation” and aims to promote and develop the country’s economy, through the identification and efficiency of state economic assets, the investment projects structuring, and the private capital mobilization with the view of economic diversification and sustainable economic development of the country.

The right to information is guaranteed by law no. 119/2014 on “The right to information”.

Every person enjoys the right to public information, without being obliged to explain the motives.

  • The request for information is made in writing and sent by hand, by mail or by Email, correctly presenting the identity of the applicant. 
  • The authority is obliged to inform the applicant whether or not it has the requested information.
  • Every person has the right to be acquainted with public information through the original document or by receiving a copy of it in the form or format that allows full access to the content of the document.

The public information provided to a person cannot be denied to any other persons who request it, except when the information contains personal data in accordance with legal restrictions.

Register of requests and responses

  • AIC creates, manages and makes a special register public, which reflects all requests for information and the information provided in response to them.
  • This register is updated every 3 (three) months and is published on the website of the public authority, as well as in the reception areas of the public authority offices. The identity of the applicants requesting information is not reflected in the register.

Competencies of the coordinator for the right to information

  1. In the implementation of the law on the right to information, in order to coordinate the work to guarantee the right to information, the Legal Division appoints one of the employees as the coordinator for the right to information.
  2. The coordinator for the right to information exercises the following powers:
  • Enables every applicant the right to familiarize himself/herself with public information, according to this law, by consulting the original document or a copy thereof.
  • Creates, maintains, publishes and updates the register of requests and responses within the stipulated period.
  • Coordinates the work to fulfil requests for information within the deadlines and according to the manner provided in this law.
  • Records requests for information and assigns a serial number to each of them.
  • Sends the request for information to another public authority, within the deadlines provided in this law. When it turns out that the public authority where the request was filed does not have the requested information.
  • Makes preliminary announcements, as well as communicates with the applicant, as necessary to handle the request for public information.

Acquaintance with public information, request for information  

  1. The request for information is made in writing and sent by hand, mail or e-mail. In any case, the request is recorded in the register of requests and responses and a serial number is assigned to it.
  2. The request for information must contain:
  • Name Surname
  • Address
  • Description of the information requested

Deadline for receiving information

  1. AIC handles the request for information, submitting the requested information as soon as possible, but no later than 10 (ten) working days from the day of its submission, unless the special law provides otherwise.

2. When the AIC sends it to another authority, the return response must occur no later than 15 (fifteen) working days from the day of receipt of the request.

3. The estimated deadline can be extended by no more than 5 (five) working days for one of the following reasons:

  • The need to search and review numerous voluminous documents.
  • The need to consult with other public authorities before deciding on whether or not to comply with the request. The decision to extend the deadline is immediately notified to the applicant.

4. In any case, failure to process the request for information within the above-mentioned deadlines will be considered a rejection.

5. Any person who believes that his rights provided by this law have been violated, has the right to complain administratively to the office of the Commissioner for the Right to Information and Protection of Personal Data.
